SECTION 5.1 - DOWNLOAD LIMITATION

After purchasing a digital product through influenzamentale.com, the user is entitled to download the associated file a maximum of five (5) times. This limit is imposed to ensure security and protect the digital content from misuse.

• Access to Downloads: Access to downloadable files will be available immediately after the purchase is completed and can be accessed through the "library" section of the user profile or via a direct link provided via email to the user.
• Download Limit: Each user may download the purchased file up to five (5) times. Once this limit is reached, the download link will become inactive and the file will no longer be available for download.
• Use of Files: Downloaded files are intended for personal, non-commercial use only. Distribution, sharing, or resale of the downloaded files to third parties is not permitted.
• Support: In case of technical issues or difficulties with the download process, the user is encouraged to contact customer support for assistance. We will make every effort to resolve any issues promptly.
• Terms Changes: influenzamentale.com reserves the right to modify the download limit terms at any time. Any changes will be communicated to users via our website.

By downloading any digital file from influenzamentale.com, the user expressly agrees to these terms and conditions regarding the download limit.

SECTION 5.2 - SHIPPING AND DELIVERY TIMES

• Shipping: Physical products purchased through the site are usually shipped within 1-2 business days from the order confirmation date, unless unforeseen circumstances or exceptional situations occur.
• Shipping Notification: Upon shipping, the Customer will receive an email with the product tracking number, allowing tracking of the shipment until delivery.
• Delivery: Standard delivery times for products range from 7 to 14 business days from the shipping date. These times reflect average delivery estimates for major locations served by our carriers and may vary due to external factors. The Customer expressly acknowledges that shipping and delivery are two distinct phases, and that the sum of shipping and delivery times may vary due to multiple factors, including but not limited to, logistical conditions, weather conditions, and carrier delays. Understanding and accepting this distinction is a prerequisite for making a purchase on the site. In case of delays beyond the provided estimates, the Customer is encouraged to check the shipment status through the provided tracking and, if necessary, contact the carrier directly. The site is committed to assisting with order tracking, but resolution of specific delays is often the exclusive responsibility of the carriers. In the event that the delivery delay is due to exceptional circumstances such as force majeure, strikes, extreme weather conditions, or other unforeseeable events, the site disclaims any responsibility for the delays experienced. In such cases, the Customer is expected to demonstrate patience and understanding, recognizing that such delays are beyond the site's reasonable control.

SECTION 5.3 - RETURNS OF PHYSICAL PRODUCTS

• Withdrawal Period: You have the right to withdraw from the purchase within 14 days from the date of receipt of the product. To exercise this right, simply send a communication to the email address: shop@influenzamentale.com, specifying your intention to return the product.
• Product Condition for Return: The product must be returned in the same condition it was delivered. It should not show damage, alterations, or signs of excessive use. Adhering to this condition is crucial to ensure your right to a refund.
• Damaged Product Upon Delivery: In the rare case that the product arrives damaged, please contact us immediately. In such circumstances, we will work with our supplier, responsible for printing and delivering the books, to resolve the issue in the most efficient and satisfactory manner. Your satisfaction is our priority, and we will do our best to handle the situation effectively.
• Return Shipping Costs: Return shipping costs are the responsibility of the customer. It is important to ensure that the product reaches our warehouse intact; therefore, we recommend using a traceable shipping service. Packages sent by cash on delivery will not be accepted.
• Digital Products: Returns are not applicable to digital products once they have been downloaded by the consumer. Due to the digital nature of such products and their immediate delivery via download or online access, it is not possible to cancel the purchase or request a refund once the download is completed.

SECTION 5.4 - COMMERCIAL "MONEY-BACK" GUARANTEE Exclusively for offers where explicitly indicated on the sales page, Influenza Mentale offers an additional "Money-Back" guarantee. This guarantee is an optional and voluntary service, subject to the following specific conditions based on product type:

A) APPLICATION TO PHYSICAL PRODUCTS For physical products, the guarantee provides for a refund of the purchase price subject to the physical return of the goods. The refund procedure will be initiated after the product has been returned to our warehouses and its integrity has been verified.

B) APPLICATION TO DIGITAL PRODUCTS (DIGITAL FAIR USE) For digital products (ebooks, courses, downloadable files), since the "return" of the file is technically impossible once downloaded or accessed, the application of the "Money-Back" guarantee is not automatic but subject to acceptance by Influenza Mentale. To prevent abuse and protect intellectual property:

• Good Faith Assessment: Refunds on digital products are conceived exclusively for customers who, after viewing the material in good faith, believe that it does not meet the promised expectations.

• Exclusion for Abuse: We reserve the right, at our sole discretion, to deny a refund if we detect behaviors aimed at acquiring the content for free without a genuine intention to purchase (so-called "friendly fraud"). The assessment will take into account various technical and behavioral factors regarding the usage and download of the file.

• Duration of the Guarantee: The terms of temporal validity of the guarantee are those indicated on the presentation page of the single product.

SECTION 5.5 - SUBSCRIPTIONS AND IM+ MEMBERSHIPS

By subscribing (such as the IM+ membership) on influenzamentale.com, you accept the following specific conditions governing the recurring service:

A) Nature of the Service and Automatic Renewal: The subscription provides continuous access to exclusive content, benefits, or reserved discounts for the duration of the chosen period (monthly, quarterly, or annual). To ensure continuity of service, the subscription automatically renews at the end of each billing cycle. The renewal amount will be charged to the payment method originally used, unless the subscription is canceled before the renewal date.

B) Payment Management: Subscription payments are processed through our secure providers (Shopify Payments, Stripe, or PayPal). It is the user's responsibility to ensure that the registered payment details are valid and up to date. If a charge is unsuccessful, we reserve the right to suspend access to subscription benefits until the debt position is regularized.

C) Cancellation Policy: You can cancel your membership at any time without any deactivation fees. Cancellation can be done independently through the reserved area of your customer profile on the site or by sending an explicit request to shop@influenzamentale.com. To avoid being charged for the next cycle, the cancellation must be received at least 24 hours before the renewal date. In the event of cancellation, you will retain access to the content and benefits of the subscription until the end of the already paid period.

D) Subscription Refunds: As indicated in Section 5.3 regarding digital products, once the user has accessed the reserved area or utilized the contents included in the subscription, the right of withdrawal is considered exercised and it will not be possible to request a refund for fees already paid. Refunds for past subscription cycles will not be granted due to a lack of use of the service by the user, as the latter remains a free choice of the customer.

E) Changes to Subscription Conditions: Influenza Mentale reserves the right to change subscription costs or included benefits. Any price variation will be communicated with at least 30 days' notice via email. The continuation of the subscription after such communication constitutes acceptance of the new terms.

SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order placed with us. At our sole discretion, we may limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed from the same customer account, using the same credit card, and/or orders that use the same billing and/or shipping address. In the event of an order modification or cancellation, we may attempt to notify you via the email address, billing address, or phone number provided at the time of the order. We also reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by wholesalers, resellers, or distributors.

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other details, such as email address, credit card numbers, and expiration dates, so that we can complete transactions and contact you as necessary.
